Amendments to the Energy Transition Law (Colombia)

Colombia recently passed Law No. 2099 on Energy Transition, which amends and complements Law No. 1715 of 2014. It aims to modernise current legislation and enact other provisions for the energy transition, the dynamisation of the energy market through the use, development and promotion of non-conventional energy sources, the economic reactivation of the country and, in general, to dictate rules for the strengthening of the public utilities of electricity and fuel gas.

The recent law includes blue and green hydrogen as non-conventional energy sources, which may apply for tax benefits, and regulates the use of new generation technologies such as geothermal energy. It also extends these tax benefits to efficient energy management projects. Investments and smart metering equipment will also be eligible for these benefits.

The Law creates the Single Energy Solutions Fund (FONENERGÍA), which will articulate and focus the different sources of resources to finance plans, projects and programmes to improve service quality, expand energy coverage, and strengthen the Non-Conventional Energy and Efficient Energy Management Fund (FENOGE).
